These SMS Terms apply to text messaging programs operated by SRBData LLC (“SRBData,” “we,” “us,” or “our”) under the SRBData brand.

Messaging programs that SRBData operates on behalf of business clients are operated under the applicable client’s brand and are governed by that client’s terms, privacy policy, consent disclosures, and messaging program requirements.

1. Program Description

SRBData may use SMS or MMS messaging to communicate with prospective clients, clients, and other persons who provide a mobile telephone number to SRBData.

Messages may concern:

  • inquiries;

  • requested information;

  • consultations;

  • appointments or meetings;

  • account or service matters;

  • customer support;

  • transaction-related communications;

  • follow-up communications; and

  • marketing or promotional communications where permitted by law and authorized by the recipient.

The type of messages you receive depends on the context in which you provided your telephone number and the consent or request associated with that number.

2. Consent

Consent to receive text messages is obtained at the point where a mobile telephone number is collected.

The specific consent disclosure presented when you provide your number governs the scope of the messaging you authorize.

Where applicable, you may consent to receive recurring automated marketing or promotional text messages from SRBData at the mobile number you provide.

Consent to receive marketing text messages is not a condition of purchasing SRBData services.

You represent that you are the subscriber or customary user of the telephone number you provide or are otherwise authorized to provide consent for that number.

3. Automated Messaging Technology

SRBData may use automated technology to send messages where permitted by applicable law and consistent with the consent provided.

For SRBData-branded marketing messaging programs, SRBData will obtain consent required by applicable law before sending automated marketing messages.

Messaging programs operated for SRBData business clients are governed by the applicable client’s consent disclosures and compliance responsibilities.

4. Message Frequency

Message frequency varies depending on your interactions with SRBData and the messaging program for which you have provided consent.

Recurring programs may result in multiple messages.

5. Message and Data Rates

Message and data rates may apply according to your mobile carrier and service plan.

SRBData does not charge a separate fee merely for receiving an SMS message, but your carrier may impose charges.

6. How to Opt Out

You may opt out of SRBData-branded SMS messages at any time by replying:

STOP

to a message from SRBData.

After processing an opt-out request, SRBData may send a final message confirming that you have been unsubscribed.

SRBData will also process other reasonable methods of revoking consent where required by applicable law.

Opting out of marketing messages does not necessarily prevent SRBData from sending non-marketing communications that are legally permitted or necessary in connection with an existing transaction, service, or request.

8. Delivery and Carrier Limitations

Delivery of SMS and MMS messages is subject to effective transmission by your wireless carrier and other communications providers.

SRBData cannot guarantee that every message will be delivered or received.

Carriers are not liable for delayed or undelivered messages.

Messaging services may not be available through every carrier, device, or geographic location.

9. Mobile Information and Messaging Consent

SRBData does not sell or share mobile telephone numbers, SMS opt-in information, or SMS consent information with third parties for their own independent marketing or promotional purposes.

SRBData may disclose mobile information to service providers, communications providers, technology providers, and other vendors that process information on SRBData’s behalf as necessary to operate the messaging program.

Those providers are not authorized by SRBData to use messaging consent information for their own independent marketing purposes.

SMS opt-in information and consent will not be shared with third parties or affiliates for their independent marketing or promotional purposes.

10. Privacy

SRBData’s collection and use of personal information associated with SRBData-branded messaging programs is governed by the SRBData Privacy Policy.

11. Changes to These SMS Terms

SRBData may update these SMS Terms from time to time.

Changes become effective when posted unless otherwise required by applicable law.

The “Last Updated” date above identifies the most recent revision.
